Way, Little Hulton, Manchester, England, M38 0DJ ("nós").
4.2 A Ata
Ouvir a Pulsoul é gratuito.
4.9 Chamadas do Welse
A função vem desligada e é ligada mensagem a mensagem.
10. Entrega programada
PARTICIPAR EXIGE ASSINATURA ATIVA.
O saldo é do criador.
- A informação pré-contratual e o atendimento.
20. Alterações
Podemos alterar estes Termos.
22. Contato
contato@whatelse.family · privacidade@whatelse.family · WHATELSE FAMILY LIMITED, nº 17425848, 203 Kenyon Way, Little Hulton, Manchester, M38 0DJ, Inglaterra.
A.1 · Os papéis
A.3 · Nossas obrigações
A.4 · Suboperadores
A.5 · Transferências internacionais
A.6 · Suas obrigações
A.7 · Auditoria
A.8 · Vigência
1. Who we are and what you sign up to
WHATELSE Family is operated by WHATELSE FAMILY LIMITED, a company incorporated in England on 28 August 2026 under number 17425848, with its registered office at 203 Kenyon Way, Little Hulton, Manchester, England, M38 0DJ (“we”).
Until 28 August 2026 the service was operated by two individuals, Matheus Alex da Silva and Cyntia Carla Pellizzer Januzzi, who incorporated the company and transferred the operation to it.
The service is an environment of applications, including Fala Aí, Fala Inbox, Pulsoul, Welse, we, PXUS, Anota Aí, Vínculos, WElupa and the assistant GWE, accessed with a single account and a single password, in the browser, with no installation from a store.
By creating an account or using the service, you agree to these Terms.
2. Age
We do not require a minimum age: people of any age may have an account. When you complete sign-up, you state your date of birth. Under 13, the account is put on hold until an adult in the house declares themselves responsible, and the child confirms. Each application may require its own minimum age, which it states in its terms (Pulsoul requires you to be 16 to publish). Today we record who declares themselves responsible and we do not verify that relationship.
BUYING AND SELLING ARE ONLY FOR PEOPLE AGED 18 OR OVER. Authorisation from the person responsible allows use; it does not replace the legal capacity to enter into contracts. Today the payment step does not ask for or verify age: a buyer states, by accepting these Terms, that they are 18 or over.
The restriction stops applying automatically on reaching the age of majority.
Minors also cannot be recognised as paid participants in a work, for the same reason: naming them, with their acceptance, is a contract.
3. Your account
There is a single entry point for the whole ecosystem: the house's. Anyone who arrives at Fala Aí or Pulsoul without an account is taken to create one in the house: neither of the two creates an account on its own. The vault has its own password. You can require an additional password for a specific application. The account is personal and non-transferable — you may not sell, lend or share access.
You are responsible for keeping your password secret. Tell us if you suspect unauthorised access.
4. What you can do
Record voice, video and the screen you show, and store them; take part in live meetings, which may be recorded, and make the Minutes of a meeting; store your own health and wellbeing information; schedule the delivery of a recording for a future date; have and use your own email address, depending on the availability of Inbox for your account; organise trips, events, projects and your family's calendar; record people and relationships; create organisational structures from what you describe; ask for help from GWE, our artificial intelligence; publish and buy content, courses and recordings and, when sales between users are active (section 14), sell them; and share whatever you want with whomever you choose.
Functions vary by application and by plan, and may change. New functions of the same kind as those described here are covered by these Terms from the moment they come into use.
4.1 Live meetings and recordings
Live meetings may be recorded, and the recording may include the voice, image and screen of those who appear, the transcript and the translation. Those who only watch do not appear. Anyone who goes on stage at a recorded meeting first signs the participation agreement (Annex B): the recording may be sold, anyone who does not want to appear watches from the audience, and anyone who signs and appears cannot later ask for the recording to be taken off sale, except for the right to ask for the passage in which they disclosed special category data to be discarded, within the period set out in the agreement. We may sell access to recordings and show them in our spaces. The sale of recordings and the participation agreement are not yet active; today, participation on stage follows the consent described in the Privacy Policy.
4.2 The Minutes
If you use the Minutes to record an in-person meeting, you declare, before each recording, that you have told everyone present that it will be recorded in audio and transcribed by artificial intelligence, that the audio will be deleted or kept by you, as you choose, and that nobody objected. Do not record anyone who does not agree. You are responsible for this declaration: the house does not verify who is present. If someone who was present asks the house to delete the audio or their name from the Minutes, the house may do so, and you accept that: the audio is deleted in full, because one person's voice cannot be removed on its own. If the law of the place where you are requires more than this, it is for you to comply with it. The Minutes are a proposal by the artificial intelligence: you review and confirm them before using them. The Minutes are not yet active.
4.3 Health and wellbeing
The health and wellbeing vault is a personal record: it keeps what you choose to record about your health, on your device, encrypted. It is for people aged 18 or over, and you declare that you are. It is not a medical device, does not make diagnoses, gives no health advice and does not replace a professional. You decide what to record and what to do with it. Fasting, in particular, is not for everyone: if you are under 18, if you are pregnant or breastfeeding, if you have or have ever had an eating disorder, or if you have diabetes or take medication that depends on eating, do not use the fasting record and speak to a health professional. The health and wellbeing vault is not yet active.
4.4 Family calendar
A person responsible for a child may add a managed member to the family calendar. You may only add a child in this way if you are responsible for them; for an adult, invite them. This function is not yet active.
4.5 Peer panel among professionals (not yet active)
The peer panel is only for lawyers, psychologists and health professionals, who bring to colleagues in the same field, without data that identifies anyone, a case they are handling, and we ask three of them to reply within 48 hours, without guaranteeing a reply. It is not advice to the public. On joining, you declare that you are a professional with a registration in force, and we do not check that registration for you. When you submit a case, you declare that it does not identify anyone and that the confidentiality you owe the person is yours. When you reply, you reply as a colleague, only on the basis of what has been described. The reply is not legal advice, psychological assessment, diagnosis, prescription or treatment, and does not create a client, patient or professional relationship between the person asking and the person replying: the decision and the responsibility belong to the person who submitted the case. If a case appears to identify someone, we remove it immediately and may suspend the account of the person who submitted it. There is no payment between colleagues.
4.6 Published pages
When you publish a nook as a page open to anyone, the page is yours: what it says and offers is your responsibility, not that of WHATELSE FAMILY, which provides the tool. At the foot of the page we add, ourselves, the legal notices, the links to the Privacy Policy and the Terms and a way to report, and you cannot remove them. The page's forms may only be used for what the text shown to the person writing says, and you are the controller of the data that arrive through them. The emails on the notification list may only be used for the notices the person asked for and confirmed, and you may not use them for anything else or pass them to third parties. A testimonial may only be shown with the consent of the person who wrote it: you may not write it, alter it or pay for it, and it comes off the page as soon as the person withdraws it. If you sell or offer services on the page, you must state on it, as the law of your country requires, who you are and how to contact you. We may take the page down under section 8.
4.7 Online consultations with independent professionals (not yet active)
In a wellbeing confraria (a members' circle), the house may bring together health and wellbeing professionals who consult online. These professionals are independent: the professional is the one who provides the consultation, you contract with them, and they are responsible for the consultation, for confidentiality and for the clinical record. WHATELSE FAMILY provides the calendar and the room and is not a party to the consultation. Each professional declares that they hold the registration required for their profession and that they may practise where you are. The house does not carry out clinical triage or assess urgency, does not record the consultation, does not read what is said in it and does not follow you between consultations. The consultation is only for people aged 18 or over and is not for emergencies: if there is a risk to your life or to someone else's, call the emergency service in your country. The “If you need help now” notice, with the numbers for each country, is always in view in these confrarias.
4.8 Voluntary contribution
In some of the house's confrarias (members' circles) and on Pulsoul, what is open to everyone may be supported by anyone who wishes, with a contribution, starting from a minimum that the screen shows before paying, in an amount and at a frequency that the person chooses. The contribution is voluntary: it buys nothing, and gives no access, priority, badge or any other advantage (except, on Pulsoul, the access described below), and it is not a donation to a charity and does not give any right to a tax deduction. A recurring contribution exists only if the person chooses it; the amount and the date of the next charge appear before paying, and it can be cancelled at any time, taking effect from the next charge. Within 14 days after a contribution, you may ask for it to be refunded. It is for people aged 18 or over. Who receives it and how it is shared is stated where the contribution is made.
Contribution on Pulsoul. Listening to Pulsoul is free. To publish pulses you must be a pulsouler, which for now is done only by invitation from our team, and be of the minimum age that Pulsoul states on the screen. The monthly limit of pulses appears on the screen and grows with the history of approved pulses, never with a contribution. Contribution to the cause (already active). Anyone who wishes may contribute to Pulsoul's cause, once, in an amount of their choosing. You pay WHATELSE FAMILY LIMITED, which sells and issues the receipt; the screen shows, before you pay, how much of the amount covers Pulsoul's costs and how much goes to the cause, and the payment fee is at your expense and is added on top. The contribution to the cause is voluntary, gives no access to content, is not a donation to a charity and does not give any right to a tax deduction; within 14 days after paying you may ask for a refund (section 4.8). What goes to the cause is kept in a record that cannot be erased, is applied to the house's own social projects (or handed to an institution, if there is a contract, in which case the screen names it before you pay), and we publish how much we receive and how we apply it at whatelse.family/causa. Contribution to a pulsouler. Anyone who wishes may contribute to a pulsouler who has a paid Imersoul and at least 12 imersouls published (only then is the Imersoul visible and does it accept contributions; before that the screen does not offer the contribution), in an amount of their choosing, starting from a minimum that the screen shows before paying, once a year or, with a minimum of its own, every month. You pay WHATELSE FAMILY LIMITED, which sells and issues the receipt, and we pass the amount on to the pulsouler through Stripe. Of the amount you choose, 89% goes to the pulsouler, 6% stays with Pulsoul, as a commission that covers administration and costs, and 5% is set aside for a social cause; the payment fee is at your expense and is added on top, and the screen shows all of this before you pay. A contribution to a pulsouler gives access to that pulsouler's imersoul content, and only theirs, for as long as it is active; whatever else it gives, the screen says before paying. Contributing is never a condition for using Pulsoul and does not give more pulse submissions. If the pulsouler has chosen anonymity, you see them by a code, and we know who they are; other users do not. About the 5%: until an institution has been chosen, WHATELSE FAMILY, which is a company, keeps them in a record that cannot be erased and either hands them to an institution or applies them to the house's own social projects, and publishes how much it received and how it applied it at whatelse.family/causa. When there is an institution, the screen names it before you pay. It is not a donation by you to an institution and does not give any right to a tax deduction. A monthly or annual contribution can be cancelled at any time, and within 14 days after paying you may ask for a refund (section 4.8). When contributing, the person chooses the country in which they want to contribute; that choice is theirs alone, and the currency does not decide it. The nomination of a pulsouler who cannot yet receive is also not yet active. The pulsouler will also be able to subscribe to Imersoul (not yet active), a monthly or annual subscription, at their choice, which widens what they can publish; what it includes and the price appear on the screen before paying. It renews every month or every year, according to the one you choose, until you cancel, the amount and the date of the next charge appear before paying, cancellation takes effect from the next charge, and within 14 days after paying you may ask for a refund. Of what is paid for Imersoul, after payment fees, 5% is set aside for a social cause, with the same record and the same notice as the 5% above. The other rules in this section also apply to Pulsoul.
4.9 Welse calls
On Welse, group call hours count per person: when the split is active, each participant uses their own allowance and anyone without Welse uses that of whoever organises the call; until then, the hours count against the allowance of whoever creates the room. Calls between two people have no limit. Above the included hours, each hour will use Gestures, only with your confirmation (not yet active). To use calls you must state your date of birth, and calls involving minors always go through protected mode. Recording a call, when it is active, requires the consent of every person, is not offered when anyone is under 18, and each person's copy takes up space in their own storage allowance. The automatic Minutes of calls are not yet active; when they are, they require each person's consent and use the Gestures of whoever organises the call.
5. Your content is yours
Everything you create remains yours. For the service to work, you grant us a limited, non-exclusive, worldwide, free and revocable licence to host, store, copy, transmit, transcribe, translate, analyse for moderation and display your content — only to the extent necessary to provide the service to you and to the people you choose, including the future delivery you schedule, and to index it so that you can search for it.
WHAT YOU PROMISED TO ANOTHER PERSON SURVIVES YOUR ACCOUNT. When you schedule a message for the future, leave an Event Chest, record a time capsule or sell a course or a recording for a fixed period, the period is paid for at the moment the promise is made, and the person waiting on the other side counts on it. For that reason, if you close your account — including in the mode that deletes everything — these things remain stored and are delivered until the end of the period you promised, and the licence you grant us to host and deliver them lasts as long, even after your account has ceased to exist. This applies only to what was promised to someone: the rest of your content is deleted as you choose. We can still remove any content that is illegal or that violates another person's rights, and in that case we refund the buyer the part of the period that was not fulfilled. After you leave, it is the house that stores and delivers these things, and it is to the house that those who receive them must turn.
APPEARING IN A RECORDING THAT WILL BE SOLD. Some meetings are recorded in order to be sold. To go on stage at one of them, you first sign a participation agreement, and it says what will happen: your image, your voice, your name and what you say stay in the recording, and whoever buys it sees all of this. In return for taking part and receiving a copy of the recording, you authorise the house to sell and show that recording in its spaces, with no time limit and without passing it to third parties, except to whoever succeeds to the business. THIS AUTHORISATION CANNOT BE UNDONE: after signing and taking part, you cannot ask for the recording to be taken off sale or for your participation to be removed from it — anyone who does not want that watches from the audience, where they do not appear. Only people aged 18 or over sign. IT REMAINS YOURS, ALWAYS: if you say something about your health, your faith, your intimate life, your orientation or your political opinions, you may ask for the passage in which you said it to be discarded, within the period stated in the agreement; and you may ask whoever is hosting to pause the recording before you speak. All of your rights over your data remain. A recording in which someone appears who did not sign the agreement is not sold.
We do not use your content for advertising or to train artificial intelligence models. Any promotional use depends on specific authorisation.
If you keep a permanent copy of another person's material, that depends on THEIR AUTHORISATION for that purpose — separate from the authorisation simply to view. That authorisation is irrevocable as to copies already made, and for that reason is requested separately and explicitly.
5.1 Sponsor brands
The service may display sponsors' brands. Where a brand may appear is decided centrally, and not by each application.
SPONSORS DO NOT RECEIVE YOUR PERSONAL DATA. They receive only aggregated metrics, such as the number of times the brand was displayed. We do not sell personal data and do not share it with sponsors.
YOU CAN TURN BRANDS OFF. If you pay for your plan, brands come turned on and can be turned off at any time, in Profile, with no change of price. Turning them off takes effect immediately: the brand stops appearing, stops being chosen by your profile and stops being recorded for you.
A brand is chosen by your gender and your region only if you have authorised the use of that data in your profile. Without that authorisation, you only see brands that do not depend on the profile.
IF YOUR PLAN IS PAID FOR BY A SPONSOR, their brand appears in your app in exchange, and this is stated before you accept. The sponsored period is whichever ends first of twelve months from when the plan was assigned to you and the end of the sponsor's campaign. You can turn the brand off at any time, but turning it off ENDS THE SPONSORSHIP: the brand disappears immediately, and the plan continues until the end of the sponsored period and then ends, with no renewal.
WHEN THE SPONSORED PERIOD IS APPROACHING ITS END, we ask the sponsor whether it wants to continue. We tell it only how many sponsored plans are ending, and never who the people are.
If the sponsor continues, we notify you thirty days before the end. You choose among three options: continue with the sponsorship, take out your own plan or let the plan end.
If the sponsor does not continue, we notify you thirty days before the end that the sponsorship will end and offer you your own plan. If you do not take it out, the sponsored plan ends on the date given.
We never turn a sponsored plan into a paid plan without you taking it out. To take it out, you see the price and confirm, and the right to cancel in section 11.3 applies.
When the plan ends, you can ask for a copy of your data, and the rules in section 15.3 apply and, if you were using another person's capacity, those in section 13. The time capsules and scheduled sendings you have already made remain valid: their hosting is paid for at the time of sending, and they are delivered on the date you set, even after the plan ends.
We do not display a sponsor's brand to minors, or to anyone who has not given their date of birth. The age considered is that at the moment the content is opened, not at the moment it was sent.
6. Content about other people
You may record information about other people, and in doing so you declare that you have the right to do so.
The service is intended for personal and family use. If you use it professionally, processing the data of clients or third parties in that capacity, you are the controller of that data and Annex A, at the end of these Terms, additionally applies and forms part of them.
Identity documents and health information require additional care: record only what is necessary, and only with the authorisation of the person to whom the document belongs — or, if a child, of whoever is responsible for them.
7. What is not allowed
7.1 Prohibited in all circumstances
- Child sexual abuse material, in any form, including that generated by artificial intelligence.
- Any sexual or sexualised content involving a child or adolescent.
- Grooming of, or inappropriate approaches to, a child.
- Harassment, threats, stalking and intimidation.
- Hate speech directed at a person or group.
- Incitement or instruction to self-harm and suicide.
- Fraud, deception and obtaining an advantage by deceptive means.
- Impersonating another person or institution.
- Illegal content or activity.
- Infringement of copyright and intellectual property.
- Using the service's email address to send unsolicited bulk email. Unwanted messages sent by one user damage the domain's reputation for everyone, including for sign-up and password-recovery emails.
EMAIL-OPEN NOTIFICATION. When writing an email, you can ask to be notified when it is opened. The function comes turned off and is turned on message by message. When you turn it on, the email carries an image that provides this notification and also carries, visible to the reader, a line saying that you will be notified of the opening — this is how the other person finds out, because they are not consulted beforehand. We do not store the network address, the email client or the location of the person who opens it. You undertake not to use this notification to stalk, pressure or monitor anyone; if you use it that way, we treat it as harassment, which is prohibited conduct under this section. The information that the message was delivered, bounced or marked as unwanted is different: it comes from our own sending service, exists for all sendings and does not depend on this choice.
- Recording third parties' data without authorisation.
- Circumventing technical limits, mass-extracting data, automating access or reselling access.
7.2 Permitted with restrictions
ADULT SEXUAL CONTENT, between adults: may be kept in your private space, because it is yours and lawful. It is not permitted to share it, publish it, make it accessible to third parties or display it on any public or recommendation surface. Selling it requires our prior approval.
CONTENT ABOUT CHILDREN: permitted for those who hold responsibility for them; prohibited for third parties.
8. Moderation
We analyse content automatically to check compliance with section 7, and we may remove, or prevent the publication of, anything that breaches it. You are informed and may ask for review by a person, by writing to contato@whatelse.family. You may also report content or behaviour, and we tell you the outcome.
On Pulsoul, before a pulse is published, an artificial intelligence that runs on our own infrastructure account transcribes the audio and analyses it. If the result is clean, the pulse is published. If it is suspect, or if the analysis cannot assess it, the pulse goes to review by a person, which may take up to 48 hours. The machine never refuses: refusal is always the decision of a person, who tells you the reason.
We state the real status of this moderation rather than describing it as complete. Automatic analysis of TEXT operates in part of the service, run on our own infrastructure account, and not on every surface on which a user publishes for others. Where it does not operate, content intended for other people must await human review before being displayed. Today we DO NOT operate automatic analysis of IMAGES or automated detection of child sexual abuse material. Implementing both, with the procedure for preservation and reporting to the authorities, is on our list.
On Fala Aí, an audio shared publicly is classified automatically (content and personal data). What the analysis flags, or cannot judge, goes to human review; what it considers clean is published without human reading. Today no one can share audio publicly.
This does not displace the prohibition in section 7 or our duty to act. Content of that kind that comes to our knowledge — by report, by human review or by any other route — is removed, preserved and reported to the competent authority.
9. Storage and period
While your plan is paid, your content is kept, within the plan's capacity. What you store for a contracted period, such as a scheduled message or a capsule, lives for that period, even if your account ends.
That period does not depend on the account: if you close the account, content whose period was contracted remains until the end of the period, and becomes available again if you create an account again with the same email within the period.
We do not delete content because you stopped using the account. What causes content to be deleted is the end of payment, when the plan ends, after notice (section 15.3); nothing is deleted before 45 days, and you can ask for a copy of what you stored. Content whose period you contracted, and the promises you left to other people, follow the contracted period.
10. Scheduled delivery
You can record today to deliver to someone on a future date. Delivery is paid for at the moment it is created, and that payment covers delivery and storage until the set date.
Once scheduled and paid for, the delivery remains guaranteed even if your account is closed afterwards. What has already been delivered belongs to the person who received it and cannot be recalled.
We are not responsible for a recipient's address that stops working in the meantime, or for events outside our reasonable control.
11. Plans and capacity
There is a free tier and there are paid plans, and each application has its own. The account and password are a single one for the house. What each plan includes, and what it opens, appears on each application's screen before you sign up, and what the screen showed when you signed up applies. Subscribing to one application does not oblige you to subscribe to the others. Vínculos stays open to every account. Saphia is not open to every account: public content is free, and the rest goes by steps (trial and subscription) for those who take it out.
- The sign-up screen shows, before payment, the final price (today without UK VAT; when there is tax, the screen shows it and adds it before you pay), how often you are charged, what is included and how to cancel. What you saw and accepted when signing up applies, and we do not change the plan you have already taken out during the paid period.
18-day trial. Each application with a paid plan has an 18-day trial, one per application; each application's screen says when the trial starts and what it includes. Pulsoul is free and has no trial. During the trial nothing is charged, unless you take out an extra or an expansion, and the trial does not turn into a paid plan by itself: it only becomes paid if you take one out. We will notify you before the end of the trial, with what is still missing and what it costs to take out a plan (this notice is not yet active). If the trial ends without you taking out a plan, your account is not closed: it moves to a free state, in which your nooks are read-only, you continue to take part in the confrarias and you have access to Pulsoul. On Fala Aí, after the trial you can no longer send, and you continue to receive. What costs money continues to require a subscription.
- Expanding storage capacity: the amount, quantity and duration of each expansion appear on the screen before you sign up. An expansion is not a subscription renewal and does not change your plan's date. The screen may offer other extras (more artificial intelligence Gestures, more broadcast hours, Fala Aí extras), each with the price, duration and refund rules shown before paying.
The quilate is a measure of occupancy. It is not currency, has no monetary value and cannot be redeemed for money.
The house's plans are charged in pounds sterling, in any country; those who sell in the house choose the currency in which they sell, and the screen shows the currency before payment. Today WHATELSE FAMILY does not charge UK VAT, because it is not yet required to register for it. If it has to start charging it, it will be added to the price of new purchases and renewals, with at least 30 days' notice. WHATELSE FAMILY is a UK company and charges only UK VAT, when due; the price of the plans is the same in any country, and any taxes of your country on the purchase, if there are any, are your responsibility.
11.1 Promotions
We may offer promotional terms for a limited time, including repeatedly on seasonal dates. The price of an annual plan may depend on when you sign up (without a trial, during the trial or after it); the screen shows the price for that moment before you pay. Each promotion states, before purchase: the promotional price; the period in which it can be taken up; to whom it applies; and the price that will be charged on renewal.
The subscription renews at the price the screen showed when you signed up. If the price changes, we notify you at least 30 days before the charge, and you can cancel before it. If the subscription is cancelled and later taken out again, the price in force at the new sign-up applies.
11.2 Renewal and cancellation
The annual plan RENEWS AUTOMATICALLY at the end of each year, at the price you signed up for (section 11.1). We will notify you at least 30 days before each renewal, stating the amount to be charged and how to cancel, and you can cancel at any time before the charge. This notice is not yet active; it will be turned on before the first renewal of any subscription. The recurring contribution (section 4.8) renews every month or every year, according to the one you chose, and can be cancelled at any time, ceasing to renew at the end of the current period. Cancellation can be requested at any time, without giving a reason: through the service itself, when the screen offers it, or in writing to contato@whatelse.family.
11.3 Right to cancel and refund
You may cancel any subscription within the first 14 days after signing up. In the first 7 days we refund the FULL amount, with no deduction, to any buyer. Between the 8th and the 14th day we refund the amount less a proportionate deduction for the period already used. On Pulsoul, the contribution and Imersoul can be refunded in full on any request made within the first 14 days after payment. We adopt the full refund in the first 7 days for everyone because art. 49 of the Brazilian Consumer Defence Code (Código de Defesa do Consumidor, CDC) requires immediate and full refund, and we prefer a single rule to a rule that depends on where the buyer lives. On cancelling, the plan ends immediately and nothing is deleted in the following 45 days, and you may ask for a copy of what you stored (section 15.3). If your bank disputes the payment, access is suspended while the dispute lasts: if we win, it is restored; if we lose, it stays suspended.
After the cancellation period, cancelling an annual plan prevents renewal and keeps access until the end of the year already paid, with no proportionate refund of the remaining period, except where the law guarantees a refund, such as failure in providing the service.
11.4 Meeting tickets
The ticket is not yet on sale. When it is, meetings will have their own ticket, sold to people with an active subscription. The ticket is for ONE SET DATE, and for that reason follows its own rules, different from those of the subscription.
IF YOU ASK FOR A REFUND BEFORE THE MEETING, the amount refunded depends on when the request arrives. In-person meeting: more than 30 days before, 100%; from 30 to 15 days before, 50%; less than 15 days before, 25%. Online meeting: up to 7 days before, 100%; less than 7 days before, 75%.
IF THE LAW OF YOUR COUNTRY GIVES YOU A RIGHT TO MORE THAN THIS SCALE, THE LAW APPLIES, and we refund the greater of the two. In Brazil, the Consumer Defence Code (Código de Defesa do Consumidor, CDC) gives seven days counted from the PURCHASE to cancel and receive 100%, even if the meeting is near, as long as it has not yet taken place.
IF YOU DO NOT ATTEND, the amount is not refunded. 25% stays with the house and the other 75% becomes the RIGHT TO REBOOK: once, within 12 months, for another meeting of any confraria, in person or online. This right can also be used to pay for your subscription. It is not money and is not refunded in money. IF YOU CLOSE THE ACCOUNT, THIS RIGHT ENDS.
ATTENDING REQUIRES AN ACTIVE SUBSCRIPTION. Without an active subscription on the day, you do not attend the meeting, and the rules above apply according to the date of your request.
IF WE CANCEL, POSTPONE OR CHANGE THE CITY of the meeting, you choose between receiving 100% back or keeping the right to rebook. The choice is yours, not ours.
The full scale is shown on the purchase screen, before payment.
12. Payment
Payments are processed by Stripe. Your card details are handled directly by Stripe and are not stored by us. The house's plans are in pounds sterling in all countries, and those who sell in the house choose the currency in which they sell; on taxes, see section 11.
13. Shared capacity
Storage spaces are individual. If you use capacity paid for by another person and their plan ends, you will be notified with reasonable notice, will be able to ask for a copy of what is yours and will be offered the chance to take out your own plan. Your content remains yours.
14. Sales between users
Sales between users are not yet active. When they are, exactly what is described in this section applies. At the start, only creators in Europe and the United Kingdom will be able to sell; Brazil comes later.
14.1 Who sells
WE ARE THE SELLER. The buyer contracts with us, the charge is made in our name, and it is to us that the buyer turns. The creator supplies us with the work, sets the price and authorises us to sell it. Payments are processed by Stripe: the amount paid by the buyer is received by us, and the creator's share is transferred to the creator by Stripe itself, to the account the creator holds with it. The creator does not receive directly from the buyer.
OF THE AMOUNT PAID BY THE BUYER, IN THIS ORDER: (1) we set aside the consumption taxes due on the sale, where they exist; (2) on the remaining amount, excluding taxes, we calculate our commission; (3) from what is left for the creator, we deduct the fee actually charged by the payment processor on that sale. The balance is the creator's.
The processor's fee is calculated by it on the TOTAL amount paid by the buyer, including the tax portion, and varies according to the card used. For that reason the amount the creator receives may vary from one sale to another, even at the same price.
THE COMMISSION DEPENDS ON HOW SOON THE CREATOR WANTS TO BE PAID. The earlier the amount is released, the less time for a complaint or refund to appear, and the higher the commission:
- Release in 45 days — 6%. This is the default period, applied to anyone who does not choose another.
- Release in 30 days — 9%.
- Release in 15 days — 15%.
- Release in 7 days — 25%.
The period is chosen by the creator, for all their sales, and not sale by sale. It can be changed once every 30 days. The change applies only to sales made after it: the commission on each sale is that of the period in force at the moment the sale happens, and does not change afterwards.
How the sum works out, without numbers: the buyer pays the price and, where there is one, the tax. We set the tax aside; on the price that remains we apply the commission for the period the creator chose; the processor's fee, calculated on the total paid by the buyer, also comes out. The creator receives what is left. The amounts for each sale are not in these Terms: they appear on the creator's screen.
This is the difference that matters most to the buyer: you do not need to find out who the creator is or negotiate with them. Your contract is with us.
14.2 What is our responsibility, towards the buyer
- Delivering what was advertised, with the quality and characteristics described, and for the contracted period.
- Refunds and returns, when due.
- The right to cancel the purchase. In the first 7 days we refund the FULL amount, with no deduction, to any buyer. Between the 8th and the 14th day we refund the amount less a proportionate deduction for the period already used. We adopt the full refund in the first 7 days for everyone because art. 49 of the Brazilian Consumer Defence Code (Código de Defesa do Consumidor, CDC) requires immediate and full refund, without reduction, and we prefer a single rule to a rule that depends on where the buyer lives.
- Pre-contractual information and customer service.
- The taxes due on the sale, where they exist.
- Moderating what is published, under section 8.
14.3 What the creator guarantees to us
By putting a work on sale, the creator declares and guarantees:
- That they have the right to sell it, and to use everything it contains — including third-party data mentioned in it, of which they are the controller.
- That the work is lawful and matches what was described.
- That they will answer to us for whatever we have to pay to the buyer, or to a third party, because of their work.
To make that guarantee effective, the amount we have to refund to the buyer is deducted from what is owed to the creator, under section 14.12.
14.4 Verification before sale, and inspection of what is on sale
Before being put on sale, what you offer goes through verification. It checks the minimum items of a saleable product and your identification as a seller. We aim to reply within 72 hours in most cases.
If the listing is refused, we say why and you can ask for review by a person, by writing to contato@whatelse.family. No refusal is final without that route being available.
In addition, we may open and examine the material on sale in five situations: for coverage checks, starting with what has never been verified or has gone longest without verification; after a report; when you contest a refusal; where there is an indication of fraud; and when the material is declared in a sensitive category. Each opening is recorded, with the reason and the order in the queue, so that it can be checked afterwards why that material was opened.
WE DO NOT OPEN WHAT YOU KEEP PRIVATE — only what you put on sale. Verification is triggered by putting on sale, and never by creating.
14.5 Price, period and withdrawal
The creator sets the price and the access period. We suggest a minimum amount, because below it the processing fees take a disproportionate part of what they would receive — but the suggestion may be ignored.
The creator can take what they created off sale. Those who have already bought keep access until the end of the contracted period; on renewal the item is no longer offered, and the buyer is told what has ceased to be available.
14.6 Works created by more than one person
The sale of works created jointly by several people, with the result shared among them, is NOT available in this version of the service. Each work put on sale has a single supplying creator, who is the one who receives from us and who gives us the guarantees in section 14.3.
If sharing of results among several people comes to be offered, these Terms will be updated beforehand, and the sharing will take this form: those who take part receive a PERCENTAGE OF THE REVENUE of identified works, and not a share of the profit of a common business; do not share in losses; and do not acquire any right of decision over the service or over other works, only over the work they created jointly, under the terms of the agreement. We record this from now because sharing results without these three conditions may constitute a de facto partnership between the participants — with each liable for the acts of the others — even if nobody intended to form one and regardless of the name given to the paper.
14.7 Collaborators
A creator may acknowledge the participation of other people in the work. Any arrangement for sharing results among them is an agreement between them, to which we are not a party and which we do not arbitrate. Payment is the obligation of whoever promised it, not ours. Participation does not constitute an employment relationship with the creator or with us.
14.8 Keeping a copy of another person's material
You may keep a permanent copy of another user's material, taking up your own capacity. This depends on express and specific AUTHORISATION from whoever created the material, separate from the authorisation simply to access it — because the copy survives the material's withdrawal from sale. That authorisation is irrevocable as to copies already made, and for that reason is requested separately.
14.9 Minors
Minors neither sell nor buy, under section 2.
14.10 Sponsored reach
A creator may allocate part of what they receive so that their work is shown to more people. This increases how many people see it, and does not change the order in which results appear. All content displayed in this way is identified as sponsored.
14.11 Broadcasting through your YouTube channel
If you connect your YouTube channel to broadcast through the house, you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms) and declare that the broadcast complies with YouTube's rules. What we receive from Google, what we use it for and how to revoke it is set out in the Privacy Policy, section 8.1. You can disconnect the channel at any time.
This function is not yet active. When it is, exactly what is described above will apply.
14.12 What happens on a refund
When a buyer exercises the right to cancel, the one who refunds the money is WHATELSE FAMILY, because it is the one that sells. The amount refunded comes out of the seller's credit.
THE HOUSE'S COMMISSION — the band of the payout plan chosen, described in section 14.1 — AND THE FEE CHARGED BY THE PAYMENT PROCESSOR ARE NOT RETURNED to the seller: the commission pays for a service that has already been provided, and the fee is not returned to us by the processor.
For that reason, a refunded sale may leave the seller's balance NEGATIVE. The negative balance is deducted from subsequent credits. If you close the account with a negative balance, we do not charge you that amount: it is closed along with the account.
If the currency in which the buyer paid differs from the currency in which the seller's account receives, the buyer gets back what they paid, in the currency in which they paid, and the exchange difference between the sale and the refund is at the seller's expense: it is deducted from the balance, like the processor's fee.
While a sale is within the full-refund period, the corresponding amount is not available for withdrawal, and the screen shows how much is held and on what date it is released. From the eighth to the fourteenth day, we show how much can still be returned proportionately.
None of this reaches the buyer: the buyer receives the amount provided for in section 11.3, full or proportionate depending on the day.
15. Suspension and termination
15.1 Immediate termination, without notice
Only in case of crime or risk to a third party: child sexual abuse material or sexualised content involving a minor; grooming of a child; credible threat of violence; use of the service for fraud or serious illegal activity; and compliance with an order from an authority.
15.2 Suspension with notice and a time limit
For the other conduct in section 7, with termination only in case of repetition or failure to correct.
15.3 Termination without penalty
For non-payment, after notice, and nothing is deleted before 45 days: in those 45 days you can ask for a copy of what you stored, and only afterwards is what exceeds the free space deleted; at your request; or by our closing the service, with at least twelve months' notice and a copy guaranteed.
Security and updates. Each application receives security fixes for at least five years, counted from the date it was released to the public. If we keep your content for a longer period, security fixes continue while the content is with us. If we are going to end support for an application, we notify you at least twelve months in advance and you can export what is yours, under section 15.3.
15.4 When closing at your request (in writing to privacidade@whatelse.family, with a reply within one month), you choose
- Close while keeping what was paid for: content whose period you contracted remains until the end of the period, and we keep your email so that it becomes available again if you return.
- Delete everything, including content whose period was contracted, losing the amount paid for it, except deliveries already scheduled for other people, which follow the contracted period.
15.5 Challenge
You may challenge any suspension or termination. The challenge is reviewed by a person, not in an automated way.
16. Death
Your content is private and remains private after your death. We do not give access to the account to heirs or third parties and we do not transfer the account. If you want someone to receive something, schedule the delivery while you can.
17. What this service is not
IT IS NOT THERAPY OR HEALTHCARE. The practices offered by WHATELSE Family, in the applications, in live broadcasts and at meetings, are wellbeing practices, inspired by holistic practices and neuroscience. We are not therapists, we do not diagnose, we do not treat diseases or conditions and we do not replace a doctor, psychologist or other qualified professional. When the house brings together independent professionals who consult online, the professional is the one who provides the consultation, not the house (section 4.7). Do not stop or fail to start treatment because of something you saw here. If you are suffering or at risk, seek professional help or an emergency service; we indicate where to find it in each country.
WHERE TO SEEK HELP: United Kingdom — 999 (emergency) or Samaritans 116 123. Brazil — 192 (SAMU) or CVV 188. Portugal — 112 (emergency) or SNS 24, 808 24 24 24.
IT IS NOT A BACKUP SYSTEM. We store things that often cannot be recovered. Keep your own originals of anything irreplaceable — you can ask for a copy of what is yours.
NO GUARANTEE OF ARTIFICIAL INTELLIGENCE ACCURACY. Transcription, translation, automatic moderation, Minutes and script generation are aids and can make mistakes. GWE, our artificial intelligence, makes proposals: what it proposes is a suggestion, and the decision, and responsibility for what you do with it, are yours.
18. Availability
We do our best to keep the service available, but we do not guarantee uninterrupted operation or the absence of faults.
19. Liability
We are liable for damage we cause by not providing the service with reasonable care and skill.
We are not liable for: content created by users; inaccuracies in artificial intelligence results; delivery of messages to third-party servers or their classification as unwanted; third-party services accessed by link; loss resulting from your own act; and third-party data that you have entered without authorisation.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law.
20. Changes
We may change these Terms. When the change is material, we will give reasonable advance notice; new functions of the same kind as those described here do not need notice. If you do not agree, you may close your account.
21. Governing law
These Terms are governed by the law of England and Wales. If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country where you live, and you may also bring proceedings in the courts of that country.
The service is offered in any country. The priority markets are the United Kingdom, Europe and Brazil, but the offer is not limited to them. The Brazilian Consumer Defence Code (Código de Defesa do Consumidor, CDC) applies mandatorily to Brazilian consumers, and the consumer law of their country of residence applies to consumers in the European Union, regardless of the choice above.
22. Contact
contato@whatelse.family · privacidade@whatelse.family · WHATELSE FAMILY LIMITED, no. 17425848, 203 Kenyon Way, Little Hulton, Manchester, M38 0DJ, England.
We aim to reply within 72 hours, counted continuously. Requests about your personal data have their own period, of up to one month.
ANNEX A · DATA PROCESSING ON BEHALF OF THE USER
This Annex forms part of the Terms of Use and applies automatically when you use WHATELSE Family in the course of professional activity, processing personal data of clients or third parties in that capacity. If you use the service only for personal and family purposes, this Annex does not apply to you.
A.1 · The roles
When you process your clients' data through the service, YOU are the controller of that data: you decide what data to record, for what purpose and for how long. WE are processors: we process that data only on your instructions and as necessary to provide the service.
The processor is WHATELSE FAMILY LIMITED, a company incorporated in England under number 17425848, with its registered office at 203 Kenyon Way, Little Hulton, Manchester, England, M38 0DJ.
This does not alter our status as controllers of the data in YOUR account — name, email, payment, usage records —, which remain governed by the Privacy Policy.
A.2 · What we process for you
- SUBJECT MATTER: hosting, storing, transmitting, indexing and displaying the data you record, and running on it the service functions that you trigger.
- DURATION: for as long as your account lasts, or the storage period you contract, whichever is longer.
- NATURE AND PURPOSE: provision of the contracted service, in accordance with your instructions.
- TYPES OF DATA: those you decide to record — typically identification, contact, content produced and documents.
- CATEGORIES OF DATA SUBJECTS: the people about whom you record information, typically your clients and contacts.
A.3 · Our obligations
- Process the data only on your documented instructions, unless required by law — in which case we will inform you beforehand, unless the law prohibits it.
- Ensure that those with access to the data are bound by confidentiality.
- Adopt appropriate technical and organisational measures, described in section 14 of the Privacy Policy.
- Assist you, to the extent reasonable, in responding to data subjects' requests and in meeting your security, incident-notification and impact-assessment duties.
- Notify you without undue delay when we become aware of an incident affecting data under your responsibility.
- At the end of processing, delete or return the data, as you choose, unless retention is required by law.
- Make available the information necessary to demonstrate compliance with this Annex.
A.4 · Sub-processors
You authorise the use of the sub-processors listed in section 8 of the Privacy Policy. We will give reasonable notice before adding or replacing any of them, and you may object — in which case you may end the service without penalty if the objection cannot be accommodated.
Of the suppliers listed in that section, Xero and the external accountant DO NOT receive the data you record in the service. They process only the billing data of YOUR account, for our accounting, and so are not sub-processors under this Annex.
We answer for sub-processors as we would for our own acts.
A.5 · International transfers
The databases are located in the European Economic Area — Ireland, Germany, France and Sweden —, except the Fala Inbox mailbox, which is in Western Europe, and the Fala Inbox attachments, which are in Cloudflare storage with no fixed jurisdiction, as described in section 9 of the Privacy Policy.
The We-mail mailbox is an exception: it is hosted in a Cloudflare database; Cloudflare is responsible for that hosting and runs it in Western Europe.
Transfers to suppliers based outside the European Economic Area are made under the Data Privacy Framework, with the UK Extension, where the supplier is certified, or under the European Union standard contractual clauses and the UK Addendum, incorporated into their contracts.
A.6 · Your obligations
- Have a legal basis for processing the data you record, and inform data subjects as the law requires of you.
- Do not record special category data — health, biometrics, racial origin, religious belief, sexual orientation, political opinions — without having a specific legal basis for doing so and without the due safeguards.
- Respond to your data subjects' requests. We assist; the obligation is yours.
- Keep your credentials secret and control who in your organisation has access.
A.7 · Audit
On reasonable request and with prior notice, we will provide the information necessary to demonstrate compliance with this Annex. On-site audits depend on prior agreement as to scope, timing and cost, and may not compromise the security or confidentiality of other users.
A.8 · Term
This Annex applies for as long as you use the service in the capacity described in the preamble, and the obligations of confidentiality and of return or deletion survive its end.
ANNEX B · RECORDING PARTICIPATION AGREEMENT
This Annex forms part of these Terms and applies to anyone who goes on stage at a recorded meeting. Appearing in this meeting, which will be recorded and may be sold.
B.1 · What may happen
This meeting is recorded. The recording may be sold — whoever buys it sees the whole meeting, including your participation: your image, your voice, your name and what you say on stage.
B.2 · What you are giving
Authorisation to record your participation and for the house to sell and show that recording in its spaces, here and in other countries, over the internet, with no time limit.
B.3 · What the house undertakes to you
This is what makes this agreement work on both sides: to use this recording only in its spaces; not to pass this authorisation to anyone else, except to whoever succeeds to the business; not to use it in advertising without your separate authorisation; to discard the passage in which you disclose something about yourself, if you ask within the period below; and to maintain all your rights over your data.
B.4 · This authorisation cannot be undone
After signing and taking part, you cannot ask for the recording to be taken off sale or for your participation to be removed from it. If you do not want that, do not sign: you can watch from the audience, where you do not appear.
B.5 · What remains yours, always
If you say something about your health, your faith, your intimate life, your orientation or your political opinions, you may ask, within 30 days afterwards, for the passage where you said it to be discarded. And, during the meeting itself, you may ask whoever is hosting to pause the recording before you speak.
B.6 · Your rights over your data
They all remain: to see what the house holds about you, to correct it, to object to new uses and to ask for a copy. What does not go back is this authorisation.
B.7 · Who signs
Only people aged 18 or over sign. Anyone who appeared in recordings made before this agreement stays under the consent regime, which they may withdraw.
